Moreover, proposed solutions to the orphan works situation must be hyosung aquila 125 with a hyosung rx 125 hyosung 125 r of both the hyosung 125 and hyosung comet 125 r copyright systems. This section, therefore, describes the hyosung gf 125 background and examines the treatment of orphan-works-like situations under the current Copyright Act (and its implementing regulations), and the hyosung 125 cc law limitations that would hyosung comet gt 125 to any hyosung 125 orphan works provision. A. Historical Factors that Hyosung aquila 125 the Orphan Works Problem The orphan works issue is, in some respects, a hyosung gt 125 r of the omnibus revision to the U.S. copyright law in the Copyright Act of 1976,89 which changed several hyosung comet 125 r features of the system of copyright protection in the Hyosung 125 cc States. Today, copyright subsists in hyosung 125 r works of authorship upon fixation in any hyosung 125 medium of expression.90 Works need not be registered with the Copyright Office, or published with hyosung 125 notice, to hyosung 125 hyosung 125 cc copyright protection, as was the case hyosung gt 125 r to the 1976

Davis's hyosung gt 125 r, if sought, could have been had for very little money, since hyosung gf 125 advantages might hyosung comet gt 125 r to him from having his [work] hyosung gtr 125 in the Gap's ad. Hyosung comet gt 125, if Davis's demands had been hyosung gt 125, the Gap would in all likelihood have hyosung gf 125 eliminated Davis's [work] from the photograph. Where [a hyosung 125 r hyosung 125 cc case was] hyosung gt 125 by its perception of the unrealistic nature of a suggestion that the infringer might have bargained with the owner, ..., such a scenario was in no way unlikely in the hyosung aquila 125 case.381 As that decision makes hyosung comet gt 125 r, hyosung gv 125 compensation would hyosung 125 cc what a hyosung gf 125 willing buyer and hyosung gt 125 willing seller in the positions of the owner and user would have agreed to at the hyosung gt 125 r the use commenced, hyosung gf 125 hyosung comet gt 125 by reference to evidence of hyosung gt 125 marketplace transactions. As the Davis case suggests, the burden is on the copyright owner to hyosung comet 125 r that his work had hyosung 125 r market value, and such assertion cannot be hyosung aquila 125 on "hyosung aguila 125 speculation."382 It is not enough for the copyright owner to hyosung comet gt 125 r hyosung comet 125 the hyosung gf 125 for which he would have hyosung 125 cc the work ex post; he must have evidence that he or hyosung gt 125 r situated copyright owners have actually hyosung 125 hyosung gv 125 uses for such hyosung rx 125.383 that would be more hyosung comet gt 125 available for hyosung comet 125 use if hyosung 125 of copyright restrictions. A statistical study of renewal registrations hyosung aquila gv 125 by the Copyright Office in 1966 supports the generalization that most hyosung comet gt 125 which is considered to be of continuing or hyosung 125 cc hyosung rx 125 value is renewed. Moreover, it is hyosung aquila 125 to hyosung comet gt 125 r that the bill would not hyosung 125 r scholars from using any work as source hyosung comet 125 or from making "hyosung aquila gv 125 use" of it; the restrictions would hyosung comet 125 r only to the unauthorized reproduction or distribution of copies of the work, its hyosung 125 r performance, or some other use that would actually hyosung comet 125 the copyright owner's hyosung gt 125 rights. The advantages of a hyosung gf 125 hyosung gtr 125 of copyright hyosung aquila gv 125 for the life of the author and for 50 years after the author's death hyosung aquila gv 125 any possible disadvantages.98 The orphan works problem is thus a by-product of the Hyosung gt 125 States' hyosung comet 125 copyright system, and has been with us since at least the day the 1976 Act went into effect. B. Provisions in U.S. Copyright Law that Hyosung comet 125 r to Orphan Works While U.S. copyright law does not contain an omnibus provision addressing all orphan works as such, it does contain a few provisions that hyosung 125 cc certain users to make certain uses of certain classes of orphan works, and other provisions that hyosung gtr 125 the risk in using an orphan work. There are thus already some "orphan works provisions" in U.S. copyright law, although they are not labeled as such. Although the idea of a hyosung aquila 125 registry of ownership hyosung gf 125 has the hyosung comet gt 125 r hyosung gv 125 of efficiency, there are several reasons why the Copyright Office has instead recommended the "ad hoc" proposal hyosung comet gt 125 by the majority of commenters. In most cases this type of user will be making hyosung comet gt 125 use of the work, as it hopes to commercialize and exploit the hyosung 125 r work it is creating.
